Terms of Use

These terms cover the SmarterPlay app and smarterplay.co, both made by SmarterTec LLC (“we”). By using SmarterPlay you agree to them and to Apple’s Licensed Application End User License Agreement, which covers apps from the App Store. Where the two differ, these terms apply as far as the law allows.
Watch only while parked
Video in SmarterPlay is for when you’re parked. Never watch, browse or use the app in a way that takes your attention off the road, and follow the laws where you drive. iOS and your car decide when video can show; using SmarterPlay safely is up to you.
Your content
SmarterPlay plays what you already have: your media servers, websites you open and your iPhone’s screen. It doesn’t provide or host any movies or shows. You’re responsible for having the right to watch what you play, and for following the terms of the servers, services and websites you use.
Other services
Plex, Jellyfin, Emby, websites and the apps you mirror are run by others. We don’t control them and aren’t responsible for them, and they may change in ways that stop them working with SmarterPlay. SmarterPlay isn’t affiliated with or endorsed by any of them.
Free time and SmarterPlay+
SmarterPlay is free for 30 minutes of playing time a day, reset at midnight. SmarterPlay+ removes the limit. It’s sold through the App Store as a subscription or as a one-time purchase, and it isn’t shared through Family Sharing. Apple handles payment and refunds under its own terms.
A subscription renews automatically at the price shown in the App Store unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged within the 24 hours before each renewal. You can manage or cancel it in your Apple Account settings; after you cancel, SmarterPlay+ stays on until the end of the period you paid for.
Restore Purchases in the app brings SmarterPlay+ back on another iPhone signed in to the same Apple Account.
Using SmarterPlay fairly
Don’t use SmarterPlay to break the law, get around copy protection, or reach servers or accounts you aren’t allowed to use.
No warranty
SmarterPlay is provided “as is”. We work to keep it reliable, but we don’t promise it will work with every car, server, website or app, or without interruption.
Limits on liability
As far as the law allows, we aren’t liable for indirect or consequential losses, and our total liability for any claim is limited to what you paid for SmarterPlay in the 12 months before it.
Changes
We may update these terms. When we do, we’ll change the date at the top; using SmarterPlay after that means you accept them.
Governing law
These terms are governed by the laws of California, USA.
Trademarks
Apple, CarPlay, iPhone and App Store are trademarks of Apple Inc. Plex, Jellyfin and Emby are trademarks of their owners.
